BRPTO resumes the novelty and originality examination of industrial design applications and extends the deadline suspension for divisional design applications

Today, June 4, 2024, the BRPTO published Ordinance #26/2024 in the Official Gazette #2787, which extends the deadline suspension for filing divisional applications (BR 32) as a result of an office action. The suspended period comprises from June 1, 2024, to June 30, 2024.

The BRPTO also published a notice informing that the examination of novelty and originality of industrial designs is resumed. Starting in June, new decisions regarding this examination will be published in the BRPTO’s Official Gazette.

The notice also informs that a few industrial design applications filed from December 15, 2023, to January 4, 2024, are still pending formal examination. It further states that the BRPTO aims to resolve the instabilities that still hinder the viewing of information and the availability of certificates issued after the Official Gazette #2758 through the Buscaweb system for industrial designs. The new estimated deadline is June 30, 2024.

Despite the issues, the BRPTO assures the integrality of the applications, as well as their respective filing dates.
