The Brazilian PTO (BRPTO) announced on September 29, 2022, that the cap for PPH (Patent Prosecution Highway) requests for 2022 has been reached. As a result, all PPH requests received after this date will not be considered until the end of this year.

Ordinance INPI/PR #13, of April 1st, 2022, establishes that Phase III of the PPH Program is restricted to 800 requests per year, considering all IPC sections, respecting the order of date and time of the PPH request protocol. A new slot of up to 800 requests will be available starting January 1, 2023.
