Seae opina contra a regra de Circuito Fechado no setor de transporte rodoviário interestadual de passageiros

No último dia 31, a Secretaria de Advocacia da Concorrência e Competitividade (Seae), da Secretaria Especial de Produtividade e Competitividade do Ministério da Economia (Sepec/ME), apresentou as conclusões da análise acerca da regra do Circuito Fechado no transporte rodoviário interestadual de passageiros por fretamento. Identificou que a norma, que proíbe empresas de fretamento de concorrer com as de transporte regular, cria custos de transação e operação, que se refletem no preço das passagens ofertadas aos consumidores. Os estudos de direito comparado e a análise jurídica e setorial do advogado do Licks Attorneys, Alexandre Schiller, objeto de sua dissertação de mestrado na Fundação Getulio Vargas, foram reiteradamente citados pela Seae.

On January 31, 2022, Brazil's Department for Fair Competition (Seae), of the Special Department for Productivity and Competitiveness of the Ministry of Economy (Sepec/ME), presented the conclusions of an analysis ran on the “Closed Circuit” rule in interstate road transport of passengers by coach. It was identified that the rule, which prohibits coach companies from competing with regular transit companies, incurs transaction and operating costs, which add to the price of tickets offered to consumers. Licks Attorneys attorney at law Alexandre Schiller carried out comparative law studies and sectoral and legal analysis as the object of his master's thesis at FGV, which was repeatedly quoted by Seae.
