Huawei, Oppo, Vivo, Xiaomi and China’s largest pharmaceutical company Hengrui Pharmaceuticals topped the rankings table for the most prolific patent filers in Brazil since 2018, according to Clarivate data. Home to the world’s ninth-largest economy, fifth-largest smartphone market, and a preliminary injunction-friendly court system, Brazil is an increasingly attractive jurisdiction for some patentees.
Speaking at IPBC China last month, Otto Licks, founding partner of Brazilian law firm Licks Attorneys, noted that Chinese patents have on average a higher grant rate when compared to the world’s average patent before the Brazil’s patent office, INPI.
Chinese patent applications have also picked up before the Brazilian patent office, he said, with Chinese businesses filing the fourth-largest number of utility patent applications four years in a row, and the second-largest amount when looking solely at the market for telecommunications, computers & electronics, and physics & electricity art units.
